On November 28, 2011, BioDelivery Sciences International, Inc. (the “Company”) issued a press release announcing that, based on a request of the Company for reexamination of US Patent No. 7,824,588 (the “588 Patent”) asserted against the Company by MonoSol RX, LLC, the United States Patent and Trademark Office has rejected all claims of the 588 Patent. A copy of such press release is attached as Exhibit 99.1 hereto.
